PUBLIC NOTICE Notice is hereby given that on Wednesday, October 5, 2016 at a Regular meeting, a bill proposing the adoption of the following proposed ordinance was introduced to and considered by City Council of the City of Meadville on first and second reading. Notice is further given that the City Council of the City of Meadville intends to consider the said proposed ordinance on third and final reading at its Regular meeting scheduled for Wednesday, October 19, 2016 at 6:00 P.M. in the Council Chambers at the Meadville City Building, 894 Diamond Park, Meadville, Pennsylvania. The proposed ordinance may be finally passed at that time. BILL NO. 8 OF 2016 CITY OF MEADVILLE CRAWFORD COUNTY, PENNSYLVANIA AN ORDINANCE OF THE CITY OF MEADVILLE, CRAWFORD COUNTY, PENNSYLVANIA, AMENDING ARTICLE 163 OF THE MEADVILLE MUNICIPAL PENSION CODE (POLICE PENSION FUND) TO UPDATE IT TO ADD DEFINED CONTRIBUTION FEATURES FOR COLLECTIVELY BARGAINED POLICE OFFICERS HIRED AFTER DECEMBER 31, 2014. WHEREAS, the City maintains the Police Pension Fund (the “Plan”) and retains the power to amend such Plan. WHEREAS, the City has agreed in collective bargaining with the Police Officers that officers hired after December 31, 2014 participate in a defined contribution retirement arrangement and not in the defined benefit features of the Plan; and WHEREAS, the City wishes to reflect the defined contribution provisions in its codified pension ordinances. BE IT ORDAINED AND ENACTED by the City Council of the City of Meadville and it is hereby Ordained and Enacted by and with the Authority thereof as follows: Section 1. Existing Article 163 of the Code is amended to include a Section 163.39 adding the provisions contained in the attached Exhibit A. Section 2. Repealer. Section 163.39 is added to the Plan which reads as follows: 163.39 Defined contributions provisions DEFINED CONTRIBUTION PLAN (A) Eligibility for Participation in Defined Contribution (DC) Features. In general, this section applies only to police employees (including those collectively bargained) hired after December 31, 2014 on the first day of employment; provided, that all prerequisites to participation under the plan have been fulfilled, including, but not limited to, completion of any probationary status and grant of regular full-time (at least 35 hours per week) employee status and after any completion of any forms required by the plan administrator. Such persons shall be referred to as participants. Any employee who participates (or is eligible to participate) in the defined contribution provisions of this section shall not be eligible to participate in the defined benefit features of this article for the same period of service. (B) The Defined Contribution Provisions contained in Section 19 of Article 165 of the City Ordinances (Paragraphs B through Q) are incorporated herein and made a part hereof such that police full-time new hires after December 31, 2014 participate in the defined contribution provisions and not in the defined benefit features of this Article. All mandatory employee contributions made after December 31, 2014 by such employees continue to be “picked up” by the employer in lieu of contributions by the employees as set forth in Subsection 19(c)(2) of Article 165.19 of the City Ordinances. (C) Normal Retirement. Normal retirement for this Section 163.39 shall be after meeting the requirements set forth in Subsection 163.14(A). 10/10/16
